Terms and Conditions
The terms and conditions below apply to all coaching provided by Starseed Transformational Life Coach (“the Coach”) to any individual or organization ("the Client") and constitute the agreement for the service to be provided by the Coach for the Client. The term 'life coaching' covers all areas life for the Client, in having the desire to improve or attain a more fulfilling life moving forward.
In return for the fees payable by the Client (or by a third party on their behalf), the Coach agrees to provide the service as described below and in accordance with the terms and conditions set out below and coaching agreement. The Client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the Client).
The date that the first paid coaching session takes place shall be deemed the start date for the service. Participation by any individual in the first paid coaching session constitutes acceptance of these terms and conditions.
1) Client-Coach Relationship
Coach agrees to maintain the ethics and standards of behavior established by the Association for Coaching (AC) global codes of ethics. It is recommended that the Client review the AC Code of Ethics and the applicable standards of behavior: https://www.associationforcoaching.com/page/AboutCodeEthics.
Client is solely responsible for creating and implementing his/her own physical, mental, and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Said Client, understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
Client further acknowledges that he/she may terminate or discontinue the coaching relationship at any time with written notice of a minimum of three (3) business days.
Client acknowledges that coaching is a comprehensive process that may involve different areas of his/her life, including professional, spiritual, finances, health, relationships, education, recreation, etc. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client’s responsibility.
Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the United States or American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If the Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and Coach.
The Client understands that to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback, assistance, guidance, and to create the time and energy to participate fully in the program.
2) Services
Coaching services will be offered within individual session or package deal. Coach will be available to the Client through scheduled sessions. Client may contact coach in between sessions via email if needed related to coaching agreement.
Package Deal: The package deal is tailored to the client's needs on a 3- or 6-month coaching agreement.
3) Schedule and Fees
This Coaching Agreement is valid for the selected coaching session/package (amount of sessions and the time allocated per session); agreed by the Client and Coach. Fee must be submitted prior to session.
Should you need to reschedule a coaching session, you may do so by providing 24-hour notice in advance of your session and making up the session within a week of the originally scheduled date. Session not cancelled 24-hours in advance will not be eligible for make-ups. It is important that you prioritize this coaching relationship to receive the full benefit of your coaching session.
4) Procedure
The time of the coaching sessions will be determined by Client and Coach based on a mutually agreed upon time and online platform, such as ZOOM or Google meetings (recorded meetings for Client reference and Coach file).
5) Confidentiality
This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound by the principles of confidentiality set forth in the AC Code of Ethics. However, please be aware that the Client and Coach relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. The Coach agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent.
Confidential Information does not include information that: (a) was in the Coach possession prior to it being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without use of or reference to the Client’s confidential information; or (e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and (g) involves illegal activity. The Client also acknowledges his/her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.
6) Release of Information
The Coach engages in training and continuing education pursuing and/or maintaining Association for Coaching Council Credentials. That process requires the names and contact information of all Clients for verification by AC Council. By signing this Agreement, you agree to have only your name, contact information, and start and end dates of coaching shared with AC Council staff members. Other than parties involved in this process for the sole and necessary purpose of verifying the coaching relationship, no personal notes will be shared.
According to the ethics of our profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and for coach professional development and/or consultation purposes.
7) Refund & Cancellation Policy
All agreements are binding. I do not offer refunds on coaching services. I am here to coach you to your highest level of success, and part of that is requiring a commitment from you that you are fully invested in your coaching. When refunds are an option, Client can have “one foot in” the work, and “one foot out” the door. It is to your benefit to decide before purchasing a session/package deal, and committing to working with me, that I am the right Coach for you. If you are in, you need to be 100% in, just as I will be for you.
“Package Deal” Purchase: This is under rare occasion, the Client-Coach relationship may not be a match, and it may be best to both parties to go their separate ways. Coach will refund the Client the remaining balance of sessions.

8) Record Retention Policy
The Client acknowledges that the Coach has disclosed his/her record retention policy with respect to documents, information and data acquired or shared during the term of the Coach-Client relationship. Such records will be maintained by the Coach in a format of the Coach’s choice (print or digital/electronic) for a period of not less than two (2) years.
9) Termination
Either the Client or the Coach may terminate this Agreement at any time with written notice of a minimum of three (3) business days.
10) Responsibilities
The Coach will seek to enable the Client to improve his/her self-esteem, quality of life, and to achieve the desired outcome(s). Remarkable results can be achieved where Clients follow a clear plan in a committed way. However, the Client has sole responsibility for taking important decisions in their life. The Coach has no liability for any loss incurred by any Client, whether financial or otherwise, following commencement of coaching sessions, or for any perceived failure by the Client, whether justified or otherwise, to achieve a material improvement in quality of esteem, life, professional or to achieve their desired outcomes or goals.
11) Variation of Terms and Conditions
Where an Initial Number of Sessions is agreed, any changes to these terms and conditions intended to take effect prior to the conclusion of those Initial Number of Sessions will only have effect if agreed by both the Coach and the Client and confirmed by the Coach in writing by email. In other cases, the Coach may change any of these terms or conditions including the Per Session Fee by giving the Client two weeks' notice in writing by e-mail of the change(s). If following receipt of such notification of change, the Client no longer wishes to proceed with further coaching sessions, Client may withdraw from the service immediately by giving notice in writing by email. The Coach will determine if the Client is entitled to a refund and if so, how much. Such notice will be effective on receipt by the Coach.
12) Governing Law
The Coaching Agreement is governed by the law of the U.S. Virgin Islands whose courts have exclusive jurisdiction in relation to any dispute, disagreement, proceedings or legal claim of any nature relating to the service provided or the agreement.
13) Disclaimer
By participating in/reading my coaching service/website/blog/email series, you acknowledge that I am not a licensed or health care professional and my services do not replace the care of psychologists or other healthcare professionals. Coaching is in no way to be construed or substituted as psychological counseling or any other type of therapy or medical advice. I will always exercise my best professional efforts, skills and care. However, I cannot guarantee the outcome of coaching efforts and/or recommendations on my website/blog/email series and my comments about the outcome are expressions of opinion only. I cannot make any guarantees other than to deliver the coaching services purchased as described.
